Hello CKG,

The Hachette v. Internet Archive case is at the Second Circuit, and various organizations and groups of individuals will be submitting amicus briefs. A couple of them - this one and the next one I'll forward - are looking for individual librarian signatories. Any individual or organization can only sign one brief. Your UL (in their individual capacity) may be signing on to a brief coming from HathiTrust. I'm not advocating for any particular brief (and haven't yet decided about signing on to one myself), but sharing FYI in case any of you want to sign and haven't seen this yet.

Subject: Sign on requested for Hachette v Internet Archive appeal amicus by 12/18

CAUTION: EXTERNAL EMAIL

It's time! Sharing out the draft joint appeal brief for sign on. Please consider signing on as an individual librarian and signatory. Thank you! Please reach out to me or Kyle K. Courtney if you have any questions.

As you might know, in March 2023, a federal district court ruled against Internet Archive for their controlled digital lending program. Many believe that the lower court made serious errors of facts and law that makes this appeal, and a special amicus brief from the library community, a necessity. Your individual voice as a member of the library and archives community is very welcome!

eBook Study Group (ESG) is inviting us to read and join other librarians and library organizations across the U.S. as they file an amicus brief for the upcoming appeal of the case (Hachette Book Grp., Inc. vs. Internet Archive, No. 20-CV-4160) in the 2nd Circuit Court of Appeals.

Please preview the draft brief in the link below and sign as individual amici if you are interested in joining the brief after reading:
https://forms.gle/6jX1wdcDVfcU2UbX8

Please note that you may sign as an individual, doing so in your individual capacity only, so any listed institutional affiliation is provided for identification purposes only. ESG is finalizing the signatory process on Monday, Dec. 18th.
