I was looking at the Direct2AAM resource that Katie mentioned in last week's SCCKG meeting, https://openaccessbutton.org/direct2aam, and there's a banner at the top that the Open Access Button will retire on November 18. OA.Works will be continuing with just two of their resources. I see in our meeting notes that the tool is going away, but wanted to highlight that in case it went over your heads like it did mine (and I took the notes 😄)

In advance of the implementation of the revised NIH public access policy, effective July 1, 2025, an Office of Scholarly Communication/Project Transform joint working group (including UC faculty and representatives from UC libraries and research offices) has developed guidance for the UC OSC site to assist UC authors in understanding and complying with the policy. Thank you and everyone else involved for this guidance on the NIH policy. It is very helpful and greatly appreciated!

I have one point that I’m trying to wrap my head around and hope to get more clarity:
The OSC guidance says: The author of any article published open access with a Creative Commons license<https://osc.universityofcalifornia.edu/scholarly-publishing/creative-commons-licenses/> can deposit the Final Published Article – the formatted PDF available on the publisher’s website – rather than the Author Accepted Manuscript.
The NIH Public Access Policy says: Submission of the Final Published Article to PubMed Central from journals or publishers with formal

Hi Michael. Since Katie is off this week, I'll do my best to address this topic (Katie and others, feel free to chime in as well). With a warning that this gets into the weeds...

Though the NIH Public Access Policy doesn't say that authors can deposit the Final Published Article (FPA) if it was published OA with a Creative Commons license, we decided to include this instruction in the OSC guidance page, since we know that the author has a right to use this version of their paper with a CC license. I'm back! Thank you Anneliese - that's way more detail than I could have provided about the NIH process and methods. Very illuminating. Like you, I'm eager to see what changes are in store for the NIH lists and other guidance this week.

And Michael, the reason we didn't say all OA articles is that we weren't confident that all articles that publishers describe as OA are actually CC licensed. There used to be a couple notable publishers where this wasn't the case (but of course now I can't remember who they were). Certainly the vast majority of OA articles

Katie, ACS used to have their own bespoke OA license, ACS AuthorChoice<https://acsopenscience.org/researchers/authorchoice-licensing-options/#:~:text=There%20are%20previous%20ACS%20journal,of%20non%2Dcommercial%20derivative%20works.>, but they now only offer two CC licenses.

Hi all:

A librarian here pointed out this new communication from ACS re:
grant-compliant publishing options for the NIH Public Access Policy:

It claims that ACS's "Article Development Charge"—which is the $2500 fee
they are charging to authors publishing in subscription/hybrid journals in
order to satisfy zero embargo deposit policies—is an allowable cost
under NIH rules.

Our working group has been going back and forth on this (just this morning!) because of this language, which can be read as just disallowing costs charged for publishers to do the depositing step:
"Journal or publisher fees that arise during the course of the publication process for the sole purpose of submitting the Author Accepted Manuscript to PubMed Central are not allowable costs. Compliance with the Policy does not require the payment of an open access fee to a journal."

Hi all,

I’d be interested to learn how embargo extension requests for dissertations and theses are handled at your campus.

UC Davis Graduate Studies requires former graduate students requesting an embargo extension to complete a form that must be signed by their major professor. Once approved, the student must then contact ProQuest and the library to request the necessary updates on the ProQuest Dissertation platform and eScholarship.

Michael,

Our graduate division must approve of any embargos longer than the 2 year maximum, which is available upon filing. In fact, any embargo extension after filing requires Grad division approval. They approve most requests, but very few go beyond an extra year or two.

We've had author-requested removals in ProQuest without the proper grad division approvals; I don't think there are any consequences.

petition process using the Embargo Extension Petition Form

Extensions are granted at the discretion of the Graduate Division, and are
based on substantiated circumstances of the kind indicated above and with
the endorsement of and an explanatory letter from the chair of the
dissertation committee (or, if the dissertation chair is unavailable, the
current department chair). Be sure to submit the petition form with
sufficient time (at least three months) prior

Hi Michael,

Similar to what others have said, UCSC students may submit
their dissertation with an initial embargo of up to two years. The UCSC
Division of Graduate Studies reviews requests for embargo renewals and may
allow two more years, rarely more. It is infrequent that the Grad Division
approves longer embargoes now (but in the past, some had been approved)
because there have been issues with extended embargoes that I emailed this
list about last summer.

Here’s UCSD’s guidelines page https://grad.ucsd.edu/academics/preparing-to-graduate/dissertation-thesis-manual.html#dissertation-and-thesis-release-form-embargo-form (I just saw this and am going to send a correction and link for this sentence “through the UC California Digital Library (eScholarship).”)
Occasionally I get direct grad student questions or referrals from the grad school, maybe 1-3 a year) on extension requests after the fact*, questions about publication timing for patent reviews, removal (examples: theater play and “threat to safety”). We created the (attached) workflow and contact list to ensure the appropriate stakeholders are notified of changes.

As mentioned in another post, Katie and I set up a document to collect responses from all campuses about working with offices on your campus that oversee grants administration and that have an interest in the rollout of new and revised public access policies from federal funding agencies. We're interested in any outreach you are planning, with or without these offices. This information will help the Federal Policy Guidance working group as it develops guidance for the emerging federal public access policies.

I recently had a conversation with Lynn Kish, the Head of our Blaisdell Medical Library, regarding the Patient Safety Network<https://psnet.ahrq.gov/> (PSNet), which is hosted by the Agency for Healthcare Research and Quality (AHRQ), a part of the Department of Health and Human Services. As of March 24, PSNet has stopped to accept new registrations and uploads.

I think it's a better data archiving/web archiving project question than an eScholarship question, like when it looked like ERIC was going to be shut down and folks started the ERICA project.

Katie and Martha, would this be a useful topic for discussion at the next
SCCKG? It would be good for campuses and libraries to be on the same page
on this from a communications/author outreach standpoint considering the
implementation is now several months sooner than planned (at least for
NIH). Michael mentioned to me on another thread that perhaps OSC could have
some guidance too.

There is a joint working group in process, with OSC representation and beyond. It was already penciled in as a working group - it came up in the last OSC meeting, but now the timeline has moved up. I'm a member, and I think Anneliese is too. The first meeting is Monday, because of the acceleration on the timeline. I'll be out for the May CKG meeting, but maybe Anneliese can provide an update? And/or I can leave something in the notes before I go?

Great to hear about the working group. I remember it mentioned in the last OSC meeting.

We are already getting questions about the accelerated timeline and the public access mandate in general (though except for the timeline nothing has changed and researchers should at least be aware of the OSTP memo, but well …) Is the working group also drafting communication and guidance for authors that we can reuse on campuses? Authors might be caught between publishers’ policies (embargo) and public access mandates (no embargo) and then contact the library.

Hi Michael and Tim. The working group is developing language for author guidance, which will be distributed to libraries. The guidance addresses the sticky situation you describe, which authors may find themselves caught up in.

Typically, the public access policies stipulate which repository articles have to be deposited in. NIH requires deposit to PubMed Central, even if the article was published OA. Unless those repositories go away, which would be a huge deal, and then the language of all of the policies would have to change. It doesn't mean we can't also recommend deposit in eScholarship, but most researchers don't want to have to deposit to more than one place.

Totally agree on the NIH part and asking authors to deposit more than once … but …the NEH designated repository just had funding cut https://about.hcommons.org/2025/04/17/on-the-neh-and-our-path-forward/ and I heard that others, NEA, etc are next. I was thinking of IRs as back up to PubMed, etc. Maybe even with data repositories as well. Maybe even implement something more systematic, like we do with Proquest UMI and the dissertations and what Alainna is looking into for MDPI (SWORD-like deposit). Auto- deposit of the pdf and metadata coming from the journal and repositories like PubMed.

I am looking at the invitation from MDPI to for IOAP institutional membership that extends a 10% discount to campus-affiliated authors. Do other campuses have a current agreement? I've heard from Davis and Berkeley.

UCSF still has an agreement. They used to send us an annual agreement to sign, but didn't for many years. They sent it to me again recently but I haven't signed it yet, simply because of time. I have concerns about some of their practices and quality, but many of our authors are flocking to their journals.

We just renewed our institutional membership. We have it for a few years and I had to sign every year, but the renewed membership remains active until we cancel it. The rep said that MDPI is interested in a UC/CDL membership and hinted on higher discount for UC authors, but that’s for others to decide.

We don't have dedicated workshop materials for this, but we do briefly
cover how to publish OA via the repository route such as AAM deposit in
this broader presentation. Take a look at slides 12-15.

Heard through a source I'm not sure I'm supposed to cite based on Chatham/Vegas rules.

Some amount of "that doesn't live here anymore" is normal under an administration change.
So, like, the OSTP under Biden didn't keep a copy of the original 2013 OSTP memo on their site, I think - it lived at obamawhitehouse.archives.gov, and the Nelson memo now lives on bidenwhitehouse.archives.gov.

I've updated the link to the archived Nelson memo on my NIH Policy guide<https://guides.ucsf.edu/nihpolicy>, and added a statement at the top of the page:

On December 17, 2024, NIH issued its updated Public Access Policy. The 2024 Public Access Policy is effective for manuscripts accepted for publication on or after December 31, 2025. Until then, NIH's current (2008) Public Access Policy remains in effect. To view the 2024 policy and supplemental guidance, please visit the NIH Office of Science Policy website<https://osp.od.nih.gov/policies/public-access/>.
We will monitor announcements in 2025 for any changes to NIH's revised policy due to the new administration.

IIRC, the agencies are supposed to have provided their draft public access
plans by Dec 31, 2024 (per the Nelson memorandum), and then will go into
effect no later than Jan 1, 2026. The article also mentions the
UC-coordinated "Right to Deposit" statement and campaign.

Alas, it cites it in the wrong section! It should be in the part about the government use license, not the part about green OA. The memo itself, and every policy I've seen, contemplates green OA as a compliance route.
Sigh. Still better than so many of these stories, right?

Echoing Michael's thanks to you, Rachel. This week, I received yet another
question from an author asking whether to sign an addendum from a publisher
to allow their book to be used for generative AI. I especially appreciated
this particular sentence from your piece for communicating about this to
authors who have questions: "When scholars write about it or teach about
the content, they are not regenerating the actual expression from the

We are at a crossroads with the records for the SCCKG. Historically our group, like other CKGs, has maintained a workspace on the UCSF wiki. The authentication system for this wiki is managed by UCSF IT. Hi Katie and Martha,

I would support the permanent switch to Google Drive. It works pretty well for larger and smaller groups (at least at Davis, I can’t speak for other campuses). I’d be happy to hand over the ownership of the SCCKG folder to you or any other owner.

My main concern with keeping the Wiki would be the risk that with another software update at UCSF we could lose access again. The last cut off was quite sudden, without warning, and Martha and I had to figure out how to save some of the files and how to

Hello everyone! Some updates about the protocols.io premium account for non-subscribing campuses (this includes Berkeley, Davis, Riverside [no response], San Diego, and Santa Cruz):

UC's premium account through the pilot agreement runs through Thursday, October 31. Springer Nature has graced access to the premium benefits for all UC locations and LBL since June 1 to allow us to work through the subscription options. As of November 1, premium account benefits will end for non-subscribing campuses. What this means for users as of November 1:

A follow-up about contacting your protocols.io users. There is admin functionality within protocols.io to notify members affiliated with your institution with the email message you input. Gabriel Gasque, Head of Outreach at protocols.io, informed me that this notification does not add a subject line and is only available if the users sign in. Therefore, it might not be the best way to communicate that the pilot will be ending (or continuing, for those in that scenario).

I’m wondering if you’ve seen these either when working with authors or as a point in the negotiations?

I’ve been working with this author over the years (Wiley, Elsevier) who comes to me every time she is publishing to find out if there are funds for APC.

This time it was for two OUP journals, one all OA and one is hybrid. I suggested that she not pay the APC for the hybrid and deposit the AAM in eScholarship. This is when I learned about the “flat publication fee.” The only time I’ve seen this fee it’s been

and foreign perspectives to the state of affairs in the U.S.

CDL has paid for a <https://osc.universityofcalifornia.edu/2022/06/ucs-protocols-io-pilot-extended/> pilot subscription to protocols.io<https://osc.universityofcalifornia.edu/2022/06/ucs-protocols-io-pilot-extended/>, an online platform for developing and sharing reproducible methods, on behalf of the UC system for the last five years. The pilot came to an end on May 31,2024, though the parent company, Springer Nature, is gracing UC’s subscription account while we come to a decision about continuing our subscription.
In order to continue the benefits of our premium subscription plan, the UC libraries and LBNL will need to take over the payment. CDL will not be contributing to the renewal costs. Since UCSF has

Our annual summer turnover of chairs is upon us, and since we are in

Thank you to Michael Ladisch for his two years of service as co-chair of

dissertation embargo practices

Hi SCCKG,

The question of dissertation embargoes is resurfacing on my campus. Long
story short, a small handful of dissertations were given really long
embargoes, owing to eScholarship technical requirements that don't allow
"indefinite" embargoes and instead require an end date for the embargo.
These 2099 embargoes have raised some questions recently, and it's not a
written policy.

Hi, Martha. You're spot on with everything as usual -- it's so varied.
We're not in the loop at all on *initial* exception approvals because Grad
Div. oversees all embargos via their forms. However, once an embargo is in
place, we sometimes receive inquiries asking us to approve extending it,
and we refer everyone to the Embargo Extension Form linked from the
Guidelines:
https://grad.berkeley.edu/academic-progress/dissertation/#embargo-extensions.
That form goes to Grad Div, and Grad Div oversees everything. The Library
has no involvement.

Because take-down requests come to me and then so many people need to be in the loop because of cataloging records, etc, I worked with the grad division, our cataloging, and Merritt on a workflow (attached) to capture who should and wants to be looped in.

In addition, I recently got this query from the asst director of the grad office and I responded with the recommendation that they not do away with the approved statement (academic record and all) and gave an option in wording based on a UCLA example;

UCLA is very similar – Grad Division makes all the decisions on this. I suppose there may be an extended embargo with the length you describe, but it depends on why the dissertation is embargoed. For publication reasons, it is generally not given. But if someone has written something politically sensitive, that may endanger family members living in another country – that kind of reasoning has led to longer embargoes.

AI contract addendum

Hi SCCKG,

This week an interesting copyright question arose at UCSC from an author
who received a contract addendum regarding AI (see attached, shared with
permission, but with the book title/ISBN redacted). I reached out to Katie
and Rachael for input, and our thread raised interesting points that I will
summarize here:

- This was new to us!
- It's nice that Cambridge asked this author, per Katie, but the
original contract probably has a statement that would cover this use, plus
there is fair use. Contracts/addendums/licenses like this unfortunately set
an expectation that people will ask before using work

I’ve been working on two related library initiatives for our campus, Publishing Literacy and Open Access Outreach & Adoption. I reuse and adjust content for the audience and hope to create materials and modules that can be reused across my library (and in some cases, beyond). The project team for the journal look-up tool includes those of us on the CDL Transformative Agreements Team (Mat, Jade, and myself), folks from CDL User Experience (Rachael Hu, John Kratz) and CDL Discovery to Delivery (Lucy Liu, Judy Dobry, Joe Ferrie).

We do not have an expected launch date and I would caution against providing a specific time frame to authors. That said, much progress has been achieved – with the goal to build a "minimum viable product" with basic search functionality fairly soon, the team has developed wireframes, built structures for the underlying data, and collected

SCCKG Wiki is still unavailable

Hi all,

The CKG Wiki space that we use for our meeting notes and other things is still unavailable for users outside of UCSF. This does not only apply to the ScholComm Wiki, but all other CKGs as well.

I’m in touch with the Wiki administrator who explained that they have to fix some security issues. She estimates that it will take +/- 6 weeks to make the Wiki available for non-UCSF users again.

find that many librarians are confused about what training AI means, how
fair use fits in, and what is needed from e-Resource license agreements to
protect scholars' TDM and AI rights. Building on our submission to the
Copyright Office

Hello all. Apologies on behalf of UCSF for the wiki problem. We just learned about the problem in the library last week. I won't be able to make this week's meeting and am only working a little while longer today before I'm off through the rest of the year, otherwise I'd offer to add updates and minutes there for others this week. Hello SCCKG colleagues. UCSF subscribes to the Dimensions Analytics<https://app.dimensions.ai/discover/publication> database from Digital Science, paid for by our Research Development Office. The Library is partnering with RDO by supporting users, setting up training, and helping with the renewal, Digital Science wants to raise the annual price pretty substantially, so I'm interested in finding out if there's any leverage we can get through a Tier 2 subscription.

Colleagues, I give up. I've been up writing a blasted Copyright Office NOI
response at 3:30 a.m. every day and my workplace is very difficult. Would a
kind soul be willing or able to forward me the 2016 or 2017 UC Annual
Report that (I think in like section 9, 10, or 12 if memory serves)
demonstrates that we publish 9% of global journal scholarship? Or anything
more recent with the number? Honestly I think the UCOP site with historical
reports is down, and my mind is just absolutely fried anyway.

Hi Allegra,

I am likewise interested to hear if other campuses are doing this and able
to integrate these systems.

At UCSC earlier this summer, I received a question on this from the
Academic Personnel Office. They wanted to know if the UC Publication
Management System could export the publication data so that they could
import it into our local system for tenure and promotion, called DivData.
So it wouldn't be a direct integration but rather data export/import. The
UCPMS of course can export publication data, but the APO was going to
investigate whether it was in the right format

The AggieExperts group worked on the project for quite some time and had a pilot with the School of Engineering. I think School of Medicine is also already integrated and heard recently that roll-out to the whole campus will happen soon.

Hello SCCKG wisdom. Do you have any guidelines for UC researchers who are entering into an editing agreement for a book? I've had a couple of people ask if the contract they've been asked to sign looks ok or if they're allowed to sign it. Since it's not about their writing but rather their work editing other authors' work, it's a different kind of contract. I haven't seen a model or ideal contract in this area so I'm wondering if there are red flags to look out for or things that we should encourage them to modify.

Hi Anneliese,

I usually have them look at the following points in the contract:

* Liability / fault – make sure the author is not on the hook for any problems that might not be their fault
* Advance/royalty – they can negotiate this but typically unless an author is a big name, they don’t feel comfortable
* Alternatively, they can ask that the publisher pay for editing and indexing rather than having this charged against author royalties
* Copyright / Language rights – we like to ask authors to negotiate for their copyright, but I usually recommend rights reversion

Another Elsevier journal editorial board exiting

In email from a faculty, they asked if the library could ensure perpetual access to the back catalog of Design Studies a premier journal in the field The journal is looking for a new home because of mismanagement by Elsevier,.

The entire editorial board has resigned, the Design Research Society, which founded and sponsors the journal, has severed ties, and it looks like many authors are withdrawing papers in the pipeline.

going to remove the title from its offering because of the mass exit of the
editorial board? Regardless, we could look to the license agreement to see
the terms/protocols for this to see what the options are regarding longer

What Tim said - I wouldn't expect the resignation of the editorial board to have any impact on availability of the back issues.
I know our licensing folks always aim for perpetual access, and I think they usually get it. I went to the redacted licenses page<https://cdlib.org/services/collections/licensed/resources/redacted-license-agreements/#E> to check the Elsevier one, but there are more Elsevier agreements and amendments than I can sort through.
Maybe Mat or Mark could verify for us?

FYI, it's related to our occasional discussion on impacts of transformative
agreements on library workers on the ground. It seems that—unlike our
situation at UC—the Swedish librarians have a fairly hands-on role in
verifying authors and approving articles to be covered by their
transformative agreements. There is some overlap in tasks, particularly
around author education and helping answer questions about TAs.

Thanks for this.

That kicker has me thinking – perhaps this whole current landscape, with APC coverage available through major & mostly commercial journals’ subscription packages, is leading to an author’s propensity to pick those journals over society journals and smaller publishers, further diminishing their ability to draw the good abstracts from authors. I doubt I ‘m the first to formulate this problem, but I wonder if there is any effort to combat this, to keep it from driving publishing choices over the coming years? I’d hate to think our system will accelerate this divide with our efforts.

It's a really good question. I think there are things that UC libraries can
do (or continue to do). One thing is to pursue a variety of pathways to
support OA, as we've been talking about for the last several years. So,
making sure we're not putting all our eggs into the transformative
agreement basket. We need to ensure support for a diversity of other models
that can benefit smaller publishers, societies, etc., as you say. Such as
putting capacity into collective funding efforts like the journals wishing
to flip to diamond through mechanisms like the Open Access

Hi all,

Our Special Collections department is digitizing older dissertation/theses to make them available open access on HathiTrust. They ask the authors for permission to do so.

Most authors agree apparently (many are flattered that “my dissertation from 1982 is of interest!” 😊). But in some disciplines there are dissertations that include author’s previously published articles in scholarly journals. And these authors ask me about the copyright situation since the copyright, especially in the old pre-OA days, was transferred to the publisher. The authors don’t want to contact the publisher to ask for permission to make the work OA and

I would tell them that it is common practice to turn an article into a chapter of a dissertation, or to turn a chapter of a dissertation into an article, and publishers know this. I've often seen it specifically called out in publishing agreements as a right reserved to the author. I've also seen articles *from publishers* giving advice on *how* to get an article from your dissertation. E.g.

Katie is right, I deal with this issue often. But this requires action by the author. Sometimes permissions must be sought, and 90+% of publishers will happily give it.

You say “authors don’t want to contact the publisher to ask for permission” – that is true and it is unfortunate You can and should advocate for it quite forcefully. I’d lay out a bullet list of how to accomplish it, and tell them only they can do it. Once done, the dissertation is freely available forever – that’s the appeal of the effort.

Marty, would you still encourage authors to contact the publisher when their current policies are like the ones below? I realize that the authors of these old dissertations signed earlier agreements that may not have looked the same as the publishers' current ones, but the likelihood seems really low that a publisher would have a problem with this, since their current policy clearly seems to view use in a thesis as noncompetitive. Especially given the optics of it.
